The Privatstiftung is Austria’s vehicle for holding family and business assets across generations. These sections cover what a private foundation may and may not do, who can found it and who benefits, the EUR 70,000 minimum assets, the foundation declaration and the confidential supplementary deed, the bodies — a board of at least three members, two resident in the EEA, from which beneficiaries and their close family are excluded, and a court-appointed auditor — and how the declaration can be amended and the foundation revoked or dissolved.

Each section below shows the English and the German side by side, paragraph by paragraph; the German text is copied from the official consolidated version (RIS) and our English is an unofficial working translation. The taxation of private foundations is in the Corporate Income Tax Act (KStG), also in this library.
