Austrian tax law
§ 2 UStG — Unternehmer, Unternehmen
(1)A trader (Unternehmer) is anyone who independently carries on a commercial or professional activity. The business comprises the entire commercial or professional activity of the trader. Commercial or professional means any sustained activity for the purpose of earning receipts, even where there is no intention to make a profit or an association of persons acts only towards its members.
(2)The commercial or professional activity is not carried on independently 1. in so far as natural persons, individually or together, are integrated into a business in such a way that they are bound to follow the trader's instructions; 2. where a legal person is so subordinate to the will of a trader that it has no will of its own. A legal person is so subordinate to the will of a trader that it has no will of its own (fiscal unity, Organschaft) where, taking all the actual circumstances into account, it is financially, economically and organisationally integrated into the trader's business. The effects of fiscal unity are limited to internal supplies between parts of the business located in Austria. These parts of the business are to be treated as one business. Where the controlling company has its place of management abroad, the economically most important part of the business in Austria is deemed to be the trader.
(3)Public-law bodies carry on a commercial or professional activity only within their commercial enterprises (§ 2 of the Corporate Income Tax Act 1988) — except those exempt from corporate income tax under § 5 point 12 of that Act — and their agricultural and forestry enterprises. However, the following are always treated as commercial enterprises for the purposes of this Federal Act: — waterworks, — slaughterhouses, — waste-disposal facilities and — facilities for the removal of waste water and refuse, as well as — the letting and leasing of real property by public-law bodies.
(4)The following is also treated as a commercial or professional activity: 1. the activity of social-security institutions and their associations, of the health-care institutions within the meaning of § 2(1) point 2 of the Civil Servants' Health and Accident Insurance Act, Federal Law Gazette No. 200/1967, and of public welfare bodies, in so far as they act within maternity, infant and youth welfare, general welfare (social assistance), war-victims' benefits, the disability acts or the acts on assistance for the blind; 4. the activity of the Federal Government in so far as it consists of permitting the use of, or transferring, railway infrastructure.
(5)The following is not treated as a commercial or professional activity: 1. the activity of office-holders within the meaning of § 29 point 4 of the Income Tax Act 1988 in the exercise of their functions; 2. an activity that, viewed over the long term, is not expected to produce profits or a surplus of receipts (hobby activity, Liebhaberei).
(6)A doctor employed by a hospital is also deemed to be a trader in so far as, in exercising their medical activity, they collect fees that count as income from self-employment under § 22 point 1(b) of the Income Tax Act 1988.
