Austrian tax law
§ 1 UStG — Steuerbare Umsätze
(1)The following transactions are subject to VAT: 1. Supplies of goods and services that a trader carries out in Austria for consideration in the course of their business. Taxability is not excluded by the fact that the transaction is effected by order of law or of an authority, or is deemed effected by law; 2. own consumption in Austria. Own consumption exists a) in so far as a trader incurs expenditure (expenses) relating to supplies that serve the purposes of the business and that are not deductible under § 20(1) points 1 to 5 of the Income Tax Act 1988 or § 12(1) points 1 to 5 of the Corporate Income Tax Act 1988. This does not apply to expenditure relating to supplies that, under § 12(2), are not deemed to be made for the business, nor to cash gifts. Tax is charged only where the item or its components gave rise to a full or partial right to deduct input VAT; 3. the importation of goods (import VAT). Importation takes place when goods enter Austria from third-country territory, with the exception of the territories of Jungholz and Mittelberg.
(2)Austria (domestic territory, Inland) is the federal territory. Abroad (Ausland) is the territory that is not domestic territory under this rule. Where a transaction is carried out in Austria, it is irrelevant for taxation whether the trader is an Austrian citizen, has their residence or seat in Austria, maintains a permanent establishment in Austria, issues the invoice or receives the payment.
(3)For the purposes of this Act, Community territory comprises Austria and the territories of the other Member States of the European Union that are treated as domestic territory of those Member States under Community law (other Community territory). The Principality of Monaco is treated as territory of the French Republic. Third-country territory for the purposes of this Act is the territory that is not Community territory. A Member State for the purposes of this Act is a Member State of the European Union. As regards goods, Northern Ireland is treated as Community territory and as a Member State (except for the application of § 6(1) point 27 and for calculating Union-wide annual turnover under Article 6a(1)).
