Foreign nationals are admitted to employment as key workers where they
1.reach the required minimum number of points for the criteria listed in Annex C and receive for the intended employment a monthly gross salary of at least 50% of the monthly maximum contribution basis under § 108(3) of the General Social Insurance Act (ASVG), Federal Law Gazette No. 189/1955, plus special payments, or
2.have completed and successfully graduated from a diploma programme at least from its second stage, or a bachelor's, master's or (PhD) doctoral programme, at an Austrian university, university of applied sciences or accredited private university, and receive for the intended employment, which must correspond to their level of education, a monthly gross salary at least equal to the local customary pay of Austrian graduates in comparable work with comparable professional experience, and the requirements of § 4(1), except point 1, are met mutatis mutandis.
For graduates under point 2, no labour-market test is carried out in the individual case.
Ausländer werden zu einer Beschäftigung als Schlüsselkraft zugelassen, wenn sie
1.die erforderliche Mindestpunkteanzahl für die in Anlage C angeführten Kriterien erreichen und für die beabsichtigte Beschäftigung ein monatliches Bruttoentgelt erhalten, das mindestens 50 vH der monatlichen Höchstbeitragsgrundlage gemäß § 108 Abs. 3 des Allgemeinen Sozialversicherungsgesetzes (ASVG), BGBl. Nr. 189/1955, zuzüglich Sonderzahlungen beträgt, oder
2.ein Diplomstudium zumindest ab dem zweiten Studienabschnitt bzw. ein Bachelorstudium, ein Masterstudium oder ein (PhD-)Doktoratsstudium an einer inländischen Universität, Fachhochschule oder akkreditierten Privatuniversität absolviert und erfolgreich abgeschlossen haben und für die beabsichtigte Beschäftigung, die ihrem Ausbildungsniveau zu entsprechen hat, ein monatliches Bruttoentgelt erhalten, das mindestens dem ortsüblichen Entgelt inländischer Studienabsolventen mit einer vergleichbaren Tätigkeit und Berufserfahrung entspricht, und sinngemäß die Voraussetzungen des § 4 Abs. 1 mit Ausnahme der Z 1 erfüllt sind.
Bei Studienabsolventen gemäß Z 2 entfällt die Arbeitsmarktprüfung im Einzelfall.
