(1)Foreign nationals are admitted to employment as skilled workers in a shortage occupation laid down in the Skilled Workers Regulation (§ 13) where they
2.reach the required minimum number of points for the criteria listed in Annex B,
3.receive for the intended employment the minimum pay due to them under law, regulation or collective agreement plus a customary company premium, and the requirements of § 4(1), except point 1, are met mutatis mutandis.
No labour-market test is carried out in the individual case.
(1)Ausländer werden in einem in der Fachkräfteverordnung (§ 13) festgelegten Mangelberuf zu einer Beschäftigung als Fachkraft zugelassen, wenn sie
2.die erforderliche Mindestpunkteanzahl für die in Anlage B angeführten Kriterien erreichen,
3.für die beabsichtigte Beschäftigung das ihnen nach Gesetz, Verordnung oder Kollektivvertrag zustehende Mindestentgelt zuzüglich einer betriebsüblichen Überzahlung erhalten und sinngemäß die Voraussetzungen des § 4 Abs. 1 mit Ausnahme der Z 1 erfüllt sind.
(2)For occupations in public transport, subsection (1) point 1 is deemed to be met by an existing authorisation under the relevant railway or transport rules, or by completed vocational training (equivalent at least to an apprenticeship certificate or a higher-school qualification) required to obtain that authorisation.
(2)Für Berufe im Bereich des öffentlichen Verkehrs gilt Abs. 1 Z 1 mit einer vorliegenden Berechtigung nach den einschlägigen eisenbahn- oder verkehrsrechtlichen Bestimmungen oder einer abgeschlossenen Berufsausbildung (mindestens einem Lehrabschluss oder Abschluss einer höheren Schule entsprechend), die für die Erlangung dieser Berechtigung notwendig ist, als erfüllt.
