Very highly qualified foreign nationals who reach the required minimum number of points for the criteria listed in Annex A are admitted to employment as key workers where the intended employment corresponds to their qualifications and to the other criteria decisive for reaching the minimum number of points, and the requirements of § 4(1), except point 1, are met mutatis mutandis. No labour-market test is carried out in the individual case.
Besonders hochqualifizierte Ausländer, welche die erforderliche Mindestpunkteanzahl für die in Anlage A angeführten Kriterien erreichen, werden zu einer Beschäftigung als Schlüsselkraft zugelassen, wenn die beabsichtigte Beschäftigung ihrer Qualifikation und den sonstigen für die Erreichung der Mindestpunkteanzahl maßgeblichen Kriterien entspricht und sinngemäß die Voraussetzungen des § 4 Abs. 1 mit Ausnahme der Z 1 erfüllt sind. Die Arbeitsmarktprüfung im Einzelfall entfällt.
