  1. 1.the foreign national's stay does not conflict with public interests;
  2. 2.the foreign national proves a legal entitlement to accommodation regarded as customary in the locality for a family of comparable size;

  6. 6.in the case of an extension application (§ 24), the foreign national has completed module 1 of the Integration Agreement under § 9 of the Integration Act (IntG), Federal Law Gazette I No. 68/2017, in time; and

(3)A residence title may be issued despite a ground for refusal under subsection (1) points 2a, 3, 5 or 6, and despite the absence of a requirement under subsection (2) points 1 to 7, where this is required to maintain private and family life within the meaning of Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights – ECHR), Federal Law Gazette No. 210/1958. In assessing private and family life within the meaning of Article 8 ECHR, the following in particular must be taken into account:
  1. 1.the nature and duration of the previous stay and whether the previous stay of the third-country national was unlawful;
  2. 2.the actual existence of family life;
  3. 3.the extent to which private life merits protection;
  4. 4.the degree of integration;
  5. 5.ties to the third-country national's home country;
  6. 6.absence of a criminal record;
  7. 7.breaches of public order, particularly in the fields of asylum, aliens police and immigration law;
  8. 8.whether the private and family life of the third-country national arose at a time when those concerned were aware of their uncertain residence status;
  9. 9.whether the length of the foreign national's previous stay is due to excessive delays attributable to the authorities.
  1. 1.die Art und Dauer des bisherigen Aufenthalts und die Frage, ob der bisherige Aufenthalt des Drittstaatsangehörigen rechtswidrig war;
  2. 2.das tatsächliche Bestehen eines Familienlebens;
  3. 3.die Schutzwürdigkeit des Privatlebens;
  4. 4.der Grad der Integration;
  5. 5.die Bindungen zum Heimatstaat des Drittstaatsangehörigen;
  6. 6.die strafgerichtliche Unbescholtenheit;
  7. 7.Verstöße gegen die öffentliche Ordnung, insbesondere im Bereich des Asyl-, Fremdenpolizei- und Einwanderungsrechts;
  8. 8.die Frage, ob das Privat- und Familienleben des Drittstaatsangehörigen in einem Zeitpunkt entstand, in dem sich die Beteiligten ihres unsicheren Aufenthaltsstatus bewusst waren;
#
(4)The stay of a foreign national conflicts with the public interest (subsection (2) point 1) where
  1. 1.their stay would endanger public order or security, or
  2. 2.the foreign national has close ties to an extremist or terrorist group and, given its existing structures or foreseeable developments in its environment, extremist or terrorist activities by that group cannot be ruled out, or certain facts give reason to assume that they seek or have sought, by spreading words, images or writings, to persuade other persons or organisations of their attitude directed against the values of a European democratic state and its society, or otherwise support a person or organisation that promotes or approves the spread of such ideas.
#
(5)The stay of a foreign national does not result in a financial burden on a regional or local authority (subsection (2) point 4) where the foreign national has fixed and regular own income that allows them to live without recourse to social-assistance benefits of the authorities and that corresponds in amount to the standard rates under § 293 of the General Social Insurance Act (ASVG), Federal Law Gazette No. 189/1955. Fixed and regular own income is reduced by regular outgoings, in particular rent, loan repayments, garnishments and maintenance payments to third parties not living in the same household. An amount up to the level laid down in the second sentence of § 292(3) ASVG is disregarded once and does not increase the income required within the meaning of the first sentence. Where means of subsistence are proved by maintenance claims (§ 2(4) point 3) or by a declaration of liability (§ 2(1) point 15), only the part of the obligor's income exceeding the subsistence minimum exempt from garnishment under § 291a of the Enforcement Code (EO), Imperial Law Gazette No. 79/1896, is to be taken into account in calculating the obligor's capacity. In proceedings on first applications, social benefits to which entitlement would arise only through the issue of the residence title, in particular social-assistance benefits or the equalisation supplement, are not to be taken into account.
#
(6)Whether proof of one or more of the requirements of subsection (2) points 2 and 4 may be furnished by a declaration of liability (§ 2(1) point 15) must be expressly stated for the purpose of residence concerned.
#
(7)On a first application, the foreign national must submit a health certificate where they would also need a health certificate under § 23 FPG to obtain a visa (§ 21 FPG).
