#(1)Third-country nationals are to be issued a residence title “EU Blue Card” where- 1.they meet the requirements of Part 1, with the exception of § 11(2) points 2 and 4, and
- 2.a written notification of the regional AMS office under § 20d(1) point 5 AuslBG is available.
(1)Drittstaatsangehörigen ist ein Aufenthaltstitel „Blaue Karte EU“ zu erteilen, wenn- 1.sie die Voraussetzungen des 1. Teiles mit Ausnahme des § 11 Abs. 2 Z 2 und 4 erfüllen und
- 2.eine schriftliche Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß § 20d Abs. 1 Z 5 AuslBG vorliegt.
#(1a)Third-country nationals holding a residence title “Red-White-Red Card” are, in proceedings under § 26, to be issued a residence title “EU Blue Card” where- 1.they meet the requirements of Part 1, with the exception of § 11(2) points 2 to 4, and
- 2.a written notification of the regional AMS office under § 20d(1) point 5 in conjunction with § 12c(5) AuslBG is available.
(1a)Drittstaatsangehörigen, die einen Aufenthaltstitel „Rot-Weiß-Rot – Karte“ innehaben, ist in einem Verfahren nach § 26 ein Aufenthaltstitel „Blaue Karte EU“ zu erteilen, wenn- 1.sie die Voraussetzungen des 1. Teiles mit Ausnahme des § 11 Abs. 2 Z 2 bis 4 erfüllen und
- 2.eine schriftliche Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß §§ 20d Abs. 1 Z 5 iVm 12c Abs. 5 AuslBG vorliegt.
#(2)Decisions on issuing a residence title “EU Blue Card” must moreover be taken by the competent settlement and residence authority and the authority competent under § 20d(1) AuslBG without delay, and in any event within eight weeks. No written notification of the regional AMS office is to be obtained where the application- 1.is to be rejected or dismissed for a formal defect or for lack of a requirement under §§ 19 to 24, or
- 2.is to be dismissed for mandatory grounds for refusal (§ 11(1)). Where it is apparent from registers accessible to the authority, or from information evident to the authority, that a requirement under § 11(2) point 1 or 5 is not met, the application is also to be dismissed in that case without obtaining the decision of the regional AMS office.
(2)Entscheidungen über die Erteilung eines Aufenthaltstitels „Blaue Karte EU“ sind überdies von der zuständigen Niederlassungs- und Aufenthaltsbehörde und der zuständigen Behörde gemäß § 20d Abs. 1 AuslBG unverzüglich, längstens jedoch binnen acht Wochen zu treffen. Von der Einholung einer schriftlichen Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice ist abzusehen, wenn der Antrag- 1.wegen eines Formmangels oder Fehlens einer Voraussetzung gemäß §§ 19 bis 24 zurück- oder abzuweisen ist oder
- 2.wegen zwingender Erteilungshindernisse (§ 11 Abs. 1) abzuweisen ist.
Ergibt sich aus der Abfrage von der Behörde zugänglichen Registern oder aus Informationen, die bei der Behörde offenkundig sind, dass eine Erteilungsvoraussetzung gemäß § 11 Abs. 2 Z 1 oder 5 fehlt, ist der Antrag auch in diesem Fall ohne Einholung der Entscheidung der regionalen Geschäftsstelle des Arbeitsmarktservice abzuweisen. #(3)Where the negative decision of the regional AMS office under § 20d(1) AuslBG on admission to employment as a key worker becomes final, the proceedings are to be discontinued without further ado.
(3)Erwächst die negative Entscheidung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß § 20d Abs. 1 AuslBG über die Zulassung zur Beschäftigung als Schlüsselkraft in Rechtskraft, ist das Verfahren ohne weiteres einzustellen.
#(4)The residence title “EU Blue Card” is to be issued for a period of two years, unless the employment contract is for a shorter period. In those cases the residence title is to be issued for a period extending three months beyond the term of the employment contract.
(4)Der Aufenthaltstitel „Blaue Karte EU“ ist für die Dauer von zwei Jahren auszustellen, es sei denn, der Arbeitsvertrag weist eine kürzere Dauer auf. In diesen Fällen ist der Aufenthaltstitel für einen um drei Monate über die Dauer des Arbeitsvertrages hinausgehenden Zeitraum auszustellen.
#(5)Subsection (1) also applies to third-country nationals granted international protection in Austria. Where the international protection of the holder of an “EU Blue Card” is withdrawn under Article 14 or 19 of the Qualification Regulation, they are, if the requirements under subsection (1) or (1a) continue to be met, to be issued ex officio and free of charge a residence title “EU Blue Card” without the entry of international protection until the end of the period of validity of the residence title originally issued.
(5)Abs. 1 gilt auch für Drittstaatsangehörige, denen in Österreich internationaler Schutz zuerkannt wurde. Wird dem Inhaber eines Aufenthaltstitels „Blaue Karte EU“ der internationale Schutz gemäß Art. 14 oder 19 der Statusverordnung entzogen, so ist ihm bei weiterem Vorliegen der Voraussetzungen nach Abs. 1 oder 1a von Amts wegen und gebührenfrei ein Aufenthaltstitel „Blaue Karte EU“ ohne Eintragung des internationalen Schutzes bis zum Ende der Gültigkeitsdauer des ursprünglich ausgestellten Aufenthaltstitels auszustellen.
