#(1)Third-country nationals may be issued a residence title “Red-White-Red Card” where they meet the requirements of Part 1, with the exception of § 11(2) points 2 and 4, and a written notification of the regional office of the Public Employment Service (AMS) under § 20d(1) point 1 AuslBG is available.
(1)Drittstaatsangehörigen kann ein Aufenthaltstitel „Rot-Weiß-Rot – Karte“ erteilt werden, wenn sie die Voraussetzungen des 1. Teiles mit Ausnahme des § 11 Abs. 2 Z 2 und 4 erfüllen und eine schriftliche Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß § 20d Abs. 1 Z 1 AuslBG vorliegt.

- 3a.a written notification of the regional AMS office under § 20d(1) point 6 AuslBG,
- 4.an expert opinion of the provincial AMS office under § 24(1) in conjunction with (3) AuslBG, or
- 5.an expert opinion of the provincial AMS office under § 24(2) in conjunction with (3) AuslBG is available.
(2)Drittstaatsangehörigen kann ein Aufenthaltstitel „Rot-Weiß-Rot – Karte“ erteilt werden, wenn sie die Voraussetzungen des 1. Teiles mit Ausnahme des § 11 Abs. 2 Z 2 und 4 erfüllen und- 1.eine schriftliche Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß § 20d Abs. 1 Z 2 AuslBG,
- 2.eine schriftliche Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß § 20d Abs. 1 Z 3 AuslBG,
- 3.eine schriftliche Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß § 20d Abs. 1 Z 4 AuslBG,
- 3a.eine schriftliche Mitteilung der regionalen Geschäftsstelle des Arbeitsmarktservice gemäß § 20d Abs. 1 Z 6 AuslBG,
- 4.ein Gutachten der Landesgeschäftsstelle des Arbeitsmarktservice gemäß § 24 Abs. 1 iVm Abs. 3 AuslBG, oder
- 5.ein Gutachten der Landesgeschäftsstelle des Arbeitsmarktservice gemäß § 24 Abs. 2 iVm Abs. 3 AuslBG vorliegt.
#(3)Decisions on issuing a residence title “Red-White-Red Card” must be taken by the competent settlement and residence authority and the authority competent under §§ 20d or 24 AuslBG without delay, and in any event within eight weeks of the application being filed. No written notification of the regional office or expert opinion of the provincial AMS office is to be obtained where the application- 1.is to be rejected or dismissed for a formal defect or for lack of a requirement under §§ 19 to 24, or
- 2.is to be dismissed for mandatory grounds for refusal (§ 11(1)). Where it is apparent from registers accessible to the authority, or from information evident to the authority, that a requirement under § 11(2) point 1 or 5 is not met, the application is also to be dismissed in that case without obtaining the decision of the regional AMS office.
(3)Entscheidungen über die Erteilung eines Aufenthaltstitels „Rot-Weiß-Rot – Karte“ sind von der zuständigen Niederlassungs- und Aufenthaltsbehörde und der zuständigen Behörde gemäß §§ 20d oder 24 AuslBG unverzüglich, längstens jedoch binnen acht Wochen ab Einbringung des Antrages, zu treffen. Von der Einholung einer schriftlichen Mitteilung der regionalen Geschäftsstelle oder eines Gutachtens der Landesgeschäftsstelle des Arbeitsmarktservice ist abzusehen, wenn der Antrag- 1.wegen eines Formmangels oder Fehlens einer Voraussetzung gemäß §§ 19 bis 24 zurück- oder abzuweisen ist oder
- 2.wegen zwingender Erteilungshindernisse (§ 11 Abs. 1) abzuweisen ist.
Ergibt sich aus der Abfrage von der Behörde zugänglichen Registern oder aus Informationen, die bei der Behörde offenkundig sind, dass eine Erteilungsvoraussetzung gemäß § 11 Abs. 2 Z 1 oder 5 fehlt, ist der Antrag auch in diesem Fall ohne Einholung der Entscheidung der regionalen Geschäftsstelle des Arbeitsmarktservice abzuweisen. #(4)Where the negative decision of the regional AMS office on admission becomes final in the cases of § 20d AuslBG, the proceedings are to be discontinued without further ado. Where the expert opinion of the provincial AMS office in proceedings on an application for admission in the case of § 24 AuslBG is negative, the application is to be dismissed without further ado.
(4)Erwächst die negative Entscheidung der regionalen Geschäftsstelle des Arbeitsmarktservice über die Zulassung in den Fällen des § 20d AuslBG in Rechtskraft, ist das Verfahren ohne weiteres einzustellen. Ist das Gutachten der Landesgeschäftsstelle des Arbeitsmarktservice in einem Verfahren über den Antrag zur Zulassung im Fall des § 24 AuslBG negativ, ist der Antrag ohne weiteres abzuweisen.
#(5)The residence title “Red-White-Red Card” is to be issued for a period of two years. Where, in the case of subsection (1) or subsection (2) points 1 to 3a, the employment contract is for a shorter period, the residence title is to be issued for a period extending three months beyond the term of the employment contract, but for no more than two years.
(5)Der Aufenthaltstitel „Rot-Weiß-Rot – Karte“ ist für die Dauer von zwei Jahren auszustellen. Weist der Arbeitsvertrag im Falle des Abs. 1 oder Abs. 2 Z 1 bis 3a eine kürzere Dauer auf, ist der Aufenthaltstitel für einen um drei Monate über die Dauer des Arbeitsvertrags hinausgehenden Zeitraum, längstens jedoch für zwei Jahre auszustellen.
